In Himachal DGP-businessman Nishant controversy, High Court defers hearing to Dec 14

SHIMLA: The Himachal Pradesh High Court on Tuesday (December 5, 2023) deferred to December 14 the hearing in the case involving Himachal Pradesh Police chief Sanjay Kundu and Palampur businessman Nishant Sharma.
As Nishant’s lawyer (amicus curiae) was not present, the High Court fixed the next hearing on December 14. Kangra Superintendent of Police Shalini Agnihotri was present in the court on behalf of the police. The High Court had earlier sought a status report from the Kangra and Shimla SPs in response to the complaint filed by Nishant.
Nishant had filed complaints against DGP Sanjay Kundu, accusing him of continuously pressuring him to visit his Shimla office. Despite not being personally acquainted with the DGP, Nishant claimed to have received persistent phone calls from the DGP’s office in Shimla, asking him to visit the office.
Nishant further alleged a life-threatening attack shortly after his communication with the DGP’s office. He issued a notice-cum-complaint to Shimla SP, seeking the registration of a case against the DGP.
In a prior instance, Nishant had written a letter to the Kangra SP, seeking the initiation of a case related to an incident. However, according to Nishant, the police did not register any case based on his complaint. On the contrary, a case was registered against Nishant at Chhota Shimla police station based on the DGP’s complaint, who had alleged that his reputation may be harmed.
Expressing concern over his and his family’s safety, Nishant had also sought police protection.
The state government had initiated an inquiry into Nishant’s complaint, directing the Shimla Police to investigate the matter.
