Advocate Vishav Chakshu Raises Nationwide Safety Demand on Two‑Wheelers Dharamshala

In a strong public interest move, Advocate Vishav Chakshu from Dharamshala has issued a legal notice under Section 80 and 91 CPC to the Ministry of Road Transport & Highways (MoRTH) and four leading two‑wheeler manufacturers – Hero MotoCorp, Honda Motorcycle & Scooter India, TVS Motor Company, and Bajaj Auto Limited.

The notice highlights that two‑wheelers currently lack an audible buzzer and auto‑cut/self‑cancelling system for turn indicators. Riders often forget to switch off indicators after turning, leading to misleading signals for other vehicles and causing accidents, particularly in hilly regions of Himachal Pradesh.

While such safety systems are mandatory in four‑wheelers, their absence in two‑wheelers is being termed “gross negligence” and a violation of Article 21 of the Constitution. Chakshu stressed that this vital safety feature costs only ₹50–₹150 per vehicle, yet its omission is contributing to rising road accidents.

Key Demands Raised:

  • Mandatory buzzer/audible alert and auto‑cut within 10–15 seconds for all two‑wheeler indicators.
  • Amendment in the Central Motor Vehicles Rules, 1989 to enforce the safety feature.
  • Consideration of retrofitting the system in existing vehicles in public interest.

The notice warns that failure to act within 60 days will result in a suit under Section 91 CPC before the Senior Civil Judge, Dharamshala, a Public Interest Litigation in the Himachal Pradesh High Court, and a complaint before the Consumer Commission.
