Shimla: The Himachal Pradesh High Court has stayed the state government’s notification to relocate the RERA (Real Estate Regulatory Authority) office from Shimla to Dharamshala. The order was passed by a division bench comprising Chief Justice Gurmeet Singh Sandhawalia and Justice Ranjan Sharma.
The high court has directed the state government to file its response regarding the matter. Advocate General Anup Rattan appeared on behalf of the state.
The decision comes after a public interest litigation (PIL) was filed by petitioner Naresh Sharma challenging the June 13 government notification. The petitioner also filed an application requesting urgent hearing in the matter.
During the proceedings, the high court also heard another PIL challenging the tenure of Chief Secretary Prabodh Saxena. Both petitions are scheduled for next hearing on August 13.
According to the PIL, the RERA office currently employs 34 personnel, including 18 outsourced staff such as drivers and Class IV workers. The petition claims that the transfer of the office to Dharamshala will disrupt the education of employees’ children and impose financial strain due to low wages and higher living costs in Dharamshala.
It further argues that the majority of RERA-related cases are registered in Baddi, Barotiwala, Solan, and Shimla, the areas geographically closer to the current office location in the state capital. In light of these concerns, the high court has put the government’s relocation notification on hold until further notice.
