Dharamshala Court Sentences Drug Trafficking Accused to 5 Years Rigorous Imprisonment

In a significant judgment under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, the Special Court (Walk-off Tribunal) in Dharamshala, chaired by Judge Jaswant Singh, sentenced Sumit Kumar, a resident of Upper Dari, Dharamshala, to five years of rigorous imprisonment and a fine of ₹1,00,000 for his involvement in heroin (chitta) trafficking.

Failure to pay the fine will result in an additional one year of simple imprisonment.

The case was registered on April 9, 2021, at Nurpur Police Station, Kangra district. According to police reports, around 7:30 PM that evening, a taxi (HP 01D 4267) was stopped at the main barrier in Kandwal during a traffic check. During inspection, a polythene packet fell from the dashboard onto the vehicle floor, which was found to contain 6.17 grams of chitta.

Ten witnesses were presented during the trial. Based on the evidence, the court held driver Sumit Kumar responsible for the recovered narcotics. The prosecution was led by District Public Prosecutor Sanjeev Rana.

In addition to the NDPS conviction, the court also found Sumit Kumar guilty under various sections of the Motor Vehicles Act, imposing the following fines:

  • Section 181: ₹5,000
  • Section 192: ₹2,000
  • Section 192A: ₹10,000
  • Section 196: ₹2,000

Failure to pay these fines will result in three months of simple imprisonment.
