Dharamshala: The Special Court of the Walf Tribunal, presided over by Judge Jaswant Singh, has convicted Prem Sagar under the Drugs and Cosmetics Act, 1940 for selling medicines without a valid license.
According to the case, on June 23, 2016, the District Drug Inspector, Nurpur, seized 150 Provan Spas capsules along with related documents from Police Chowki Damtal. The medicines were recovered from the possession of the accused, Prem Sagar, who failed to produce any valid license.
The seized medicines were sealed on the spot and later taken into custody after obtaining court orders. Prosecution was initiated with the approval of the State Drug Controller, Himachal Pradesh.
Based on the evidence and testimonies, the court held that the accused had violated Sections 18(c) and 18A of the Drugs and Cosmetics Act, 1940.
Sentence
Under Section 27(b)(ii): Three years’ simple imprisonment and a fine of ₹1,00,000. In default of payment, the accused will undergo an additional one year of imprisonment.
Under Section 28: One year’s simple imprisonment and a fine of ₹20,000. In default of payment, he will undergo an additional three months of imprisonment.
The case was prosecuted by District Public Prosecutor Sanjeev Rana.
