Himachal High Court defers hearing in DGP-businessman Nishant Sharma controversy case, wasn’t heard last time too

The hearing in the Himachal Pradesh High Court in the case related to the controversy involving Director General of Police Sanjay Kundu and Palampur businessman Nishant Sharma that was scheduled on Thursday (December 14, 2023) has been deferred. The new date for the hearing is yet to be specified.
The case could not be heard due to the absence of Chief Justice Mamidanna Satya Ratna Sri Ramachandra Rao. The case will now be heard on Friday. Even during the last hearing on December 5, the matter could not be heard as Nishant Sharma’s lawyer (amicus curiae) was not present in the court and the case was then fixed for December 14.
The police were supposed to file a status report in the court on the investigation conducted so far. The matter was last taken up for hearing on November 22. At that time, the lawyer appointed by the court for the complainant had expressed dissatisfaction with the police investigation. After this, the government had decided to hand over the investigation to an Additional Superintendent of Police-rank officer.
The Himachal Pradesh High Court has taken cognizance of the complaint of Nishant Sharma, who had complained to the state government as well as to the Shimla and Kangra SPs as well as the High Court.
In his complaint, Nishant Sharma had levelled allegations that he got calls from the DGP’s office and was asked to come to Shimla. Nishant had tried to link the calls to a property dispute he was having with his business partner. A case has been registered against Nishant Sharma in Shimla on behalf of DGP Kundu who had alleged that his reputation may be harmed. Nishant has also complained to the Shimla SP and had demanded the registration of an FIR against the DGP.
