SC stays disqualification of six Himachal Chief Parliamentary Secretaries

In a relief to the Sukhvinder Singh Sukhu-led Congress government in Himachal Pradesh, the Supreme Court on Friday (November 22, 2024) stayed the disqualification of six Chief Parliamentary Secretaries.
The cop court stay came on a petition filed by the Sukhu government against the order of the Himachal Pradesh High Court declaring the state’s power to appoint Chief Parliamentary Secretaries and Parliamentary Secretaries as unconstitutional.
A Bench of Chief Justice Sanjiv Khanna and Justice Sanjay Kumar said there will be no further proceedings in pursuant to the Himachal Pradesh High Court order quashing the appointment of six MLAs as Chief Parliamentary Secretaries.

It, however, also made it clear that no more appointments would be made by the state government saying, it will be contrary to law.
The top court also issued a notice to BJP leader Kalpana Devi, who had moved the high court against the appointment of Chief Parliamentary Secretaries and sought her response within two weeks. The top court posted the matter after four weeks and tagged the case with pending petitions on the issue.
