The Supreme Court will also hear Arvind Kejriwal’s petition on Tuesday. While hearing Kejriwal’s petition on Monday, the Supreme Court had asked why he did not file the petition before the trial court. To which, Kejriwal’s lawyer Abhishek Manu Singhvi said that there are several reasons for this, one of which is that Kejriwal’s arrest itself is illegal.
Delhi Chief Minister Arvind Kejriwal is embroiled in the Delhi liquor policy scam and has filed a petition in the Supreme Court stating that his arrest is illegal and his detention is also illegal.
This is being done under the guise of politics just before the general elections. Kejriwal stated in his petition that an attempt is being made to end a political party and overthrow an elected government. Justices Sanjiv Khanna and Deepankar Datta are hearing the petition. During the hearing on Monday, Abhishek Manu Singhvi said that anyone can be arrested only on the basis of evidence of a crime, not just on suspicion.
Singhvi Presented These Arguments
Justices Sanjiv Khanna and Deepankar Datta are hearing the petition. During the hearing on Monday, Abhishek Manu Singhvi said that anyone can be arrested only on the basis of evidence of a crime, not just on suspicion. Despite repeated issuance of summons, the court raised questions as to why Kejriwal was not presented for interrogation and asked, what was the way for the investigating officers in such a situation?
In response, Singhvi said that not registering a statement is not a basis for arrest. If the ED can come to the CM’s residence for arrest, then why can’t they come to register a statement?
